The conundrums of the reasonable patient standard in English medical law

Montgomery v Lanarkshire Health Board (2015) was a landmark case in English Medical Law and introduced the concept of material risks (to find out more click here). It also advocated a dialogue approach to consent and a partnership approach which aimed to make patients more informed.

This article explores the case and also considers some of the difficulties in its implementation.
